ARTICLE 1. DEFINITIONS

1.1 General Terms and Conditions (hereinafter referred to as "Terms"): The following delivery and payment conditions apply to all sales made via www.supadawg.nl. You agree to these when placing an order.
1.2 Business: www.supadawg.nl (hereinafter referred to as "SupaDawg") is the trading name of SupaDawg and is an online store offering dog clothing and related items through "distance selling" to consumers.
1.3 Consumer: a natural person or company who enters into a distance agreement with the business.
1.4 Agreement: a distance agreement between SupaDawg and the consumer.

ARTICLE 2. APPLICABILITY

2.1 These terms apply to every offer made by SupaDawg and to every distance agreement made between the business and the consumer.
2.2 All offers, orders, and agreements made using the website www.supadawg.nl are subject to these terms.
2.3 Before a distance agreement is concluded, these terms are made available through our website. Accepting an offer or placing an order means these terms are accepted.
2.4 Deviations from the provisions in these terms are only valid if agreed upon in writing. If one part of these terms is deviated from, the rest of the provisions remain in force. Any deviations agreed upon do not grant the consumer rights for future transactions.
2.5 Unless otherwise agreed in writing, SupaDawg does not acknowledge the general or specific terms or conditions of third parties.

ARTICLE 3. AGREEMENTS

3.1 An agreement is only formed after your order has been accepted by SupaDawg. SupaDawg is entitled to refuse orders or attach conditions to the delivery, unless explicitly agreed otherwise. If an order is not accepted, you will be notified of this, including the reason, within five (5) business days after receiving the order.

ARTICLE 4. PRICES

4.1 All offers from SupaDawg are non-binding. SupaDawg explicitly reserves the right to change prices, especially when required by (legal) regulations.
4.2 The prices listed for the offered products are in euros, including VAT. Shipping costs are not included in the listed prices unless otherwise stated. The total price is communicated via the website before the agreement is concluded.
4.3 SupaDawg is not bound by incorrect price listings, for example, due to input errors, typographical errors, or printing mistakes. No rights can be derived from incorrect price information.

ARTICLE 5. PAYMENTS

Payments are always made in full in advance.
5.1 Payment can be made in various ways as indicated during the ordering process. Additional (payment/order) conditions may be imposed on the consumer's order. After placing an order, the consumer will immediately receive confirmation by email detailing the total costs.
5.1.1 iDeal: If you use online banking, you can securely pay for your order electronically via our site. An electronic payment via the internet is similar to a PIN payment in a store. After placing your order, you choose the payment method iDeal. A screen will open where you can select the bank you use for online banking. You will follow the procedure you're familiar with for internet banking. The payment is typically processed the same day. For more information, we refer you to the iDeal website.
5.1.2 In the event of bankruptcy or suspension of payment of the consumer (or a request for this), SupaDawg's claims are immediately due.
5.1.3 If SupaDawg must hand over its claim for collection, the consumer will owe a fixed amount of 15% for out-of-court collection costs. If SupaDawg can prove it incurred higher necessary costs, these will also be charged to the consumer.

ARTICLE 6. DELIVERY

6.1 All items from the online shop are available from stock. If an item is unexpectedly unavailable, we will notify the consumer as soon as possible.
6.2 SupaDawg aims to ship all orders within 1 to 3 business days after receiving payment. This will be sent to the delivery address provided with the order. If the delivery time differs for any reason, the consumer will be notified via email. In principle, an order will always be shipped within 1 to 3 business days after payment is received.
6.3 Exceeding the specified delivery time does not entitle the consumer to compensation, termination of the agreement, or non-compliance with any obligation arising from this or any related agreement.
6.4 The order must be delivered to the consumer no later than 30 days after being placed. If it is not possible to deliver an order within 30 days, the consumer will be informed in time and has the right to cancel the order free of charge. In such a case, SupaDawg will ensure a refund. This does not apply if the parties have agreed on a different delivery term.
6.5 Partial deliveries are allowed.
6.6 SupaDawg's delivery obligation is fulfilled once the delivery has been offered.
6.7 In case of refusal or failure to collect the offered delivery, return shipping and storage costs, as well as the risk of damage or loss, will be borne entirely by the consumer.
6.8 The offered products are clearly and accurately depicted and/or described and as complete as reasonably required. However, there may be color, type, text, and/or price deviations from the actual product.
6.9 SupaDawg is never liable for consequential damage. At SupaDawg, we pack your order with great care and attention. Each package is carefully and securely packed in a shipping bag to ensure it is delivered in good condition. If the package is delivered opened or tampered with, we will initiate an investigation with our shipping partners. In this case, SupaDawg cannot be held liable.

ARTICLE 7. RETENTION OF TITLE

7.1 Ownership of delivered products only transfers to the consumer once they have paid everything they owe SupaDawg under the agreement(s) for the delivered products.

ARTICLE 8. RETURNING/EXCHANGING ITEMS

8.1 SupaDawg strives to provide information about the products on our website. If you do not wish to keep an item, you have the right to return or exchange it in the store within 14 business days after receiving the order.
8.2 During this period, the consumer should handle the product and packaging with care. They will only unpack or use the product to the extent necessary to determine if they wish to keep it. If they exercise their right to exchange, they must return the product with all accessories and, if reasonably possible, in its original condition and packaging, following SupaDawg's reasonable and clear instructions.

Returns may be rejected in the following cases:

  • Original packaging or labels missing
  • Worn, used or washed
  • Damaged or stained after receiving the item
  • Items with noticeable odors such as perfume, sweat or other odors indicating that
  • the item is no longer in new condition
  • Items with dog hair on them
  • Articles that are no longer in new condition

8.3 SupaDawg only accepts returns/exchanges if the instructions are followed. Returns/exchanges received outside the specified time will not be accepted.
8.4 The consumer is responsible for returning the item(s).
8.5 Upon receipt of the goods, you will receive confirmation by email. The purchase amount will be refunded within 15 business days to the account the payment was made from.

ARTICLE 9. COMPLAINTS

Complaints regarding delivery and/or the quality of your order.
9.1 We do our utmost to deliver a perfect product. Upon receiving your order, you must immediately inspect the delivered goods and report any defects immediately in writing. If an item is not delivered according to your order or does not meet the description on our website, you must notify us immediately by sending an email to service@supadawg.nl. This guarantee expires if you attempt to repair the defect yourself without consultation and/or fail to follow the instructions for use.
If you have such a complaint about an item purchased from us, we would like to hear from you. You must report this to us immediately by sending an email to service@supadawg.nl.
We will resolve the issue as soon as possible in consultation with you, which may take up to 14 business days. In all cases, the instructions for returning, as provided when filing your complaint, must be followed exactly.
To ensure the smooth processing of your complaint, we request that you strictly follow our instructions.

ARTICLE 10. LIABILITY

10.1 Any liability of SupaDawg, its personnel, and its products for any damage of any kind, direct or indirect, including business damage, consequential damage, damage to movable or immovable property, or to persons or animals, is expressly excluded. SupaDawg is also not liable for any damage caused by third parties during the execution of the agreement.
10.2 SupaDawg accepts no liability for any damage resulting from the use of SupaDawg's products.
10.3 SupaDawg's liability towards the buyer is in any case limited to the invoice amount that the buyer owes SupaDawg under the relevant agreement.
10.4 SupaDawg is not responsible for misunderstandings, mutilations, delays, or failure to properly transmit orders and communications due to the use of the internet or any other communication means between the consumer and SupaDawg, or between SupaDawg and third parties, unless there is intent or gross negligence on the part of SupaDawg.

ARTICLE 11. FORCE MAJEURE

11.1 In the event of force majeure, SupaDawg has the right, at its own discretion, to suspend the execution of a consumer's order or to dissolve the agreement without judicial intervention, by informing the consumer in writing. SupaDawg is not liable for any compensation unless, in the given circumstances, this would be unreasonably unacceptable according to standards of reasonableness and fairness.
11.2 Force majeure is defined as any failure that cannot be attributed to SupaDawg because it is not due to its fault and cannot be attributed to it by law, legal act, or generally accepted practices.

ARTICLE 12. APPLICABLE LAW AND COMPETENT COURT

All rights, obligations, offers, orders, and agreements to which these terms apply, as well as all matters between SupaDawg and the consumer to which these terms relate, are governed exclusively by Dutch law.
